In latter June of 2012, a confession to record in a Jury Instructions hearing pre-trial, by the 9th Judicial deputy district attorney Andrea Bryan; finally declared a truth in this case. That they had known all along they had no case of crime.  That if they were not going to be allowed by the Court to utilize what is known as 'the hearsay rule', they would acquit. Despite extensive citing of law and impropriety arguments from my defense; Andrea Bryan was granted full hearsay allowance and the defense was denied all ability to impeach.  In other words, was not allowed to confront anything the prosecution brought forward through hearsay testimony. 

This site will be posting official case records that substantiate the information it holds.  Among those records are transcripts and confessions of the path the charged victims (and) the hearsay collusion from many others took that began in 2007 and drove the next three years of business dealings of mine into full-out bankruptcy and inability to stay solvent. There will also be the posting of bankruptcy transcripts that reveal the failings of these people to not pay their debts owed to my company. Those bankruptcy transcripts reveal that the federal Trustees went after all of the uncollected assets of mine in order to make them pay what they owed and what I had previously been unable to collect.  The June of 2012 hearing mentioned above will be one of the transcripts that will be posted to this site.

For now, as the case remains in the Colorado Court of Appeals (18 CA 1740), the postings here will be kept to a minimum in order to make certain that any upcoming court processes, on appellate or district levels, stay on track and have the time required to slowly move upward.  In the case of appeal now that process is over two years old.   

Since opening this site up to the ability to follow and email in, I have received a number of requests to explain what the page titles mean.  I do not think my answering briefly at this time harms any portion of the Court processes in place now as all coming to the site eventually is already public record or in the public eye.

So, for now, here is the breakout of the outline of this site:

• "Official Case Records":  Is as stated.  One of the most serious problems with logistics in the case became the district attorney's inability, after creating the avenue for it, in being unable to control the "hearsay". Which actually, was primarily a collection of hearsay within hearsay.  More than a bit like that old game of 'Telephone' we all have played at one time or another in our lives.  One person states a one-line comment, whispers to the next, then that person whispers to the next and so on.  In this case the internet and a whole lot of yellow "journalism" was used.  And then, assisted by an individual very highly skilled at optimizing search and content results.  A bit like Pinocchio's nose, as in this case the comments whispered to begin it all held intent to deceive in order to harm.  A very successful strategy when the intent is to bury something not wanted to be seen.  Over the years however, that legalese burying still could never control the human nature of the type of hearsay this case held. It definitely is a very flawed judicial system that we have to work within.  But the one thing it does do is track. Transcripts, affidavits, statements, orders all do hold a very clear and documented trail of where, when, what and how Pinocchio came to be and just how very long her nose became.  All the collateral harm, in the destruction of people and lives that optimized hearsay did to myself, my family and our lives; can be seen in the official trails of certain documents.  At the appropriate times for the case now, official records direct from the mouths of individuals will be posted on this page.  

• "Keep Those Trolls A'Movin' " :  This page will hold, from those official and public records, the links to the individuals who truly did such an amazing job of orchestrating what they began as gossip in 2007, they have continued their endeavors through to present day!  Wow!  Over thirteen years of trollin' !  Such stamina and endurance!  Just think.  Once launched fully, right here on this site, ya'all will be able to link and click away right over to their personal sites and pages! Ease of convenience to have the accumulation at your fingertips!  Such an amazing job, yet forgotten that when official records time came, to stay hidden on the Dark Web.  Lure of the spotlight too much to resist and their names and the names of those they 'branded'  and 'herd' moved were officially revealed. Here's the thing about social media and the internet when it is used for that sort of thing (and) when it drags innocents (including very private people by nature such as myself and that my son was):  unless you are only using it for a commercial enterprise such as advertising or selling (or) you are only talking about yourself, you are invading and harming others.  Interesting thing the past few years of politics in this country has done for us all, in that maybe, just maybe, the internet will finally and eventually stop being used as a weapon more lethal than a bullet.  Until then, one cannot fight back to defend innocence and innocents by getting into the same formats as the cyber perpetrators and branders.  But, if one is equal in intelligence and skill set of communications, one can appropriately and at the right timing expose while still remaining taking the Higher Road. 

• JALER:  Stands for Judicial, Attorney, Law Enforcement Reforms.  Even after the long, long 10 years just past:  Hope Springs Eternal.  I did not set out to have a case or a life that held such a story of events that could, or do, or did, affect others in ways that invoke true and positive lasting change for many.  But that is what a large portion of my life now holds.  I don't want it.  My hope is to gather it all into a nice tidy bundle of information and then pass it forward.  As you will review on "Did you hear that right??",  I have enough on my plate with my health.  But I do believe that when one's power is shown, then their responsibility becomes greater.  JALER is the concept of an organization that will hold information and show (hopefully) clear directions to follow for all those seekers of reforms out there.

·   “Under Oath”:  This page will eventually hold official case records of this case and official records from other courts and agencies that I worked with, that verify the disinformation, false testimonies and the sequence of events plus timelines that expose how all of this went so far wrong.  It will be a long time from now, due to how slow the court system works; before certain individual testimonies can be exposed and confronted to the public eye. The integrity of the case has to be upheld and cared for when it comes to charged and alleged victims. However, everything that is in the public eye that does not fall into that type of protected status falls into appropriate category for placing now, alongside facts already exposed and more upcoming.  One of the categories is local Valley “journalists” and “investigative reporters” of print media.
